Henkil\u00f6tietojen k\u00e4sittelyn tarkoitus ja k\u00e4sittelyn peruste sek\u00e4 vastaanottoryhm\u00e4t<\/strong><\/p><p>Henkil\u00f6tietoja k\u00e4sittelyn peruste ja tarkoitus on sosiaali- ja terveydenhuollon asiakastietojen k\u00e4sittelyst\u00e4 annetun lain (ns. asiakastietolaki, laki 703\/2023) edellytt\u00e4m\u00e4n potilas- ja asiakasrekisterin yll\u00e4pit\u00e4minen: EU:n yleinen tietosuoja-asetuksen 6 artiklan 1 c) alakohta (k\u00e4sittely on tarpeen rekisterinpit\u00e4j\u00e4n lakis\u00e4\u00e4teisen velvoitteen noudattamiseksi). Muiden henkil\u00f6tietojen osalta k\u00e4sittelyperuste on asetuksen 6 artiklan 1 b alakohta (k\u00e4sittely on tarpeen sopimuksen t\u00e4yt\u00e4nt\u00f6\u00f6npanemiseksi).<\/p><p>Potilasrekisteriin kuuluvat mm. potilaan nimi, henkil\u00f6tunnus, kotiosoite, muut yhteystiedot sek\u00e4 kaikki hoidon j\u00e4rjest\u00e4misess\u00e4 ja toteuttamisessa k\u00e4ytett\u00e4vi\u00e4, laadittuja tai saapuneita asiakirjoja taikka teknisi\u00e4 tallenteita, jotka sis\u00e4lt\u00e4v\u00e4t asiakkaan terveydentilaa koskevia tai muita henkil\u00f6kohtaisia tietoja. N\u00e4in ker\u00e4ttyj\u00e4 tietoja k\u00e4ytet\u00e4\u00e4n terveydenhuollon palveluiden tuottamiseen ja siihen kiinte\u00e4sti liittyviin toimintoihin. Asiakkaan yhteystietoja voidaan k\u00e4ytt\u00e4\u00e4 lain sallimalla tavalla my\u00f6s palveluiden markkinointiin. S\u00e4hk\u00f6inen suoramarkkinointi kuluttaja-asiakkaalle edellytt\u00e4\u00e4 erillist\u00e4 suostumusta.<\/p><p>Rekisterinpit\u00e4j\u00e4 voi k\u00e4ytt\u00e4\u00e4 potilastietojen k\u00e4sittelyss\u00e4 alihankkijoita, kuten s\u00e4hk\u00f6isi\u00e4 potilastietoj\u00e4rjestelmi\u00e4 tuottavia yrityksi\u00e4 tai muita terveydenhuollon palveluntuottajia. T\u00e4ll\u00f6in sopimuskumppanin kanssa laaditaan EU:n tietosuoja-asetuksen 28 artiklan ja yll\u00e4 mainitun asiakastietolain edellytt\u00e4m\u00e4 sopimus henkil\u00f6tietojen k\u00e4sittelyst\u00e4.<\/p><p>Potilastiedot ovat lakis\u00e4\u00e4teisen salassapitovelvollisuuden piiriss\u00e4 (asiakastietolaki 4 \u00a7 ja 5 \u00a7 sek\u00e4 rikoslain 38 luvun 1 ja 2 \u00a7). Potilastietoja ei luovuteta sivullisille ilman lakiin perustuvaa syyt\u00e4 tai asiakkaan nimenomaista ja erikseen saatua suostumusta. Sivullisella tarkoitetaan muita kuin asianomaisessa toimintayksik\u00f6ss\u00e4 tai sen toimeksiannosta potilaan hoitoon tai siihen liittyviin teht\u00e4viin osallistuvia henkil\u00f6it\u00e4.<\/p><p>S\u00e4\u00e4nn\u00f6nmukaisesti asiakkaan henkil\u00f6tietoja luovutetaan edell\u00e4 mainittujen perusteiden t\u00e4yttyess\u00e4 seuraaville tahoille: Diarium-potilastietoj\u00e4rjestelm\u00e4 (jonka p\u00e4\u00e4k\u00e4ytt\u00e4j\u00e4 on Marjo Valtonen, Mielipuhe Oy, Y-tunnus 3339746-2), kuntoutuksesta vastaava julkisen terveydenhuollon taho sek\u00e4 Kela.<\/p><p><strong>3. Henkil\u00f6tietojen s\u00e4ilytysaika<\/strong><\/p><p>Potilastietoja s\u00e4ilytet\u00e4\u00e4n niin pitk\u00e4\u00e4n kuin yll\u00e4 mainittu asiakastietolaki sek\u00e4 sen s\u00e4ilytysliite edellytt\u00e4v\u00e4t. P\u00e4\u00e4s\u00e4\u00e4nt\u00f6isesti potilastietoja s\u00e4ilytet\u00e4\u00e4n asetuksen mukaisesti 12 vuotta potilaan kuolemasta, tai mik\u00e4li kuolemasta ei ole tietoa, 120 vuotta potilaan syntym\u00e4st\u00e4.<\/p><p><strong>4. Rekister\u00f6idyn oikeudet<\/strong><\/p><p>Rekister\u00f6ityn\u00e4 sinulla on tietosuoja-asetuksen mukainen oikeus pyyt\u00e4\u00e4 sinusta ker\u00e4ttyj\u00e4 tietoja n\u00e4ht\u00e4ville sek\u00e4 oikeus pyyt\u00e4\u00e4 kyseisten tietojen oikaisemista, poistamista tai pyyt\u00e4\u00e4 k\u00e4sittelyn rajoittamista sek\u00e4 vastustaa tietojen k\u00e4sittely\u00e4. Mik\u00e4li kyseess\u00e4 on s\u00e4hk\u00f6isesti tuotettu tieto, jonka k\u00e4sittely perustuu sopimukseen, on sinulle my\u00f6s oikeus saada sinusta ker\u00e4tyt automaattisesti k\u00e4sitellyt tiedot siirretyksi s\u00e4hk\u00f6isesti j\u00e4rjestelm\u00e4st\u00e4 toiseen.<\/p><p>Silt\u00e4 osin kuin tietojen s\u00e4ilytys perustuu lakiin, ei rekister\u00f6idyll\u00e4 ole ehdotonta oikeutta vaatia potilastietoja poistettavaksi tai oikeutta vastustaa tai rajoittaa tietojen lakis\u00e4\u00e4teist\u00e4 k\u00e4sittely\u00e4 tietosuoja-asetuksen sallimalla tavalla. Hoidon yhteydess\u00e4 annettavat pakolliset tiedot on lueteltu yll\u00e4 viitatun asiakastietolain 27 \u00a7:ss\u00e4.<\/p><p><strong>5. Oikeus peruuttaa suostumus<\/strong><\/p><p>Potilastietojen k\u00e4sittely ei perustu rekister\u00f6idyn suostumukseen, vaan on rekisterinpit\u00e4j\u00e4n lakis\u00e4\u00e4teinen velvollisuus. Milloin (muiden kuin lakis\u00e4\u00e4teisten potilas-) tietojen k\u00e4sittely perustuu suostumukseen, on sinulla rekister\u00f6ityn\u00e4 oikeus peruuttaa t\u00e4llainen suostumus milloin tahansa. Suostumuksen peruuttaminen ei viel\u00e4 kuitenkaan lopeta henkil\u00f6tietojen k\u00e4sittely\u00e4, mik\u00e4li k\u00e4sittelylle on muu tietosuoja-asetuksen 6 artiklassa mainittu tai lains\u00e4\u00e4d\u00e4nn\u00f6ll\u00e4 s\u00e4\u00e4detty peruste.<\/p><p><strong>6. Oikeus tehd\u00e4 valitus valvontaviranomaiselle<\/strong><\/p><p>Rekister\u00f6ityn\u00e4 sinulla on oikeus tehd\u00e4 tietojesi k\u00e4sittelyst\u00e4 valitus valvontaviranomaiselle. Toimivaltainen valvontaviranomainen Suomessa on tietosuojavaltuutetun toimisto www.tietosuoja.fi<\/p><p><strong>7. Henkil\u00f6tietojen antaminen on palvelun suorittamisen lakis\u00e4\u00e4teinen edellytys<\/strong><\/p><p>Henkil\u00f6tietojen (nimi, yhteystiedot, kotipaikka, henkil\u00f6tunnus jne.) antaminen on terveydenhuollon palveluiden antamisen edellytys ja perustuu potilaan asemasta ja oikeuksista annettuun lakiin ja asetukseen. Potilastietojen tallentamisesta lakis\u00e4\u00e4teiseen kansalliseen Kanta-arkistoon informoidaan yll\u00e4 mainitun asiakastietolain edellytt\u00e4m\u00e4ll\u00e4 tavalla Kelan Kanta-palveluiden omilla materiaaleilla tai suullisesti. Annettu Kanta-informointi kirjataan aina suoraan Kanta-palveluihin erilleen palveluntuottajan potilasrekisterist\u00e4.<\/p><p><strong>8. Automaattinen p\u00e4\u00e4t\u00f6ksenteko tai profilointi<\/strong><\/p><p>Rekisterinpit\u00e4j\u00e4n hallinnoimien henkil\u00f6tietojen k\u00e4sittelyyn ei liity automaattista p\u00e4\u00e4t\u00f6ksentekoa tai profilointia.<\/p><p><strong>9. Tietojen k\u00e4ytt\u00f6tarkoituksen muutoksesta on ilmoitettava asiakkaalle<\/strong><\/p><p>Jos rekisterinpit\u00e4j\u00e4 aikoo k\u00e4sitell\u00e4 henkil\u00f6tietoja edelleen muuhun tarkoitukseen kuin siihen, johon henkil\u00f6tiedot alun perin ker\u00e4ttiin, on rekisterinpit\u00e4j\u00e4n tietosuoja-asetuksen mukaisesti ilmoitettava rekister\u00f6idylle ennen kyseist\u00e4 jatkok\u00e4sittely\u00e4 t\u00e4st\u00e4 muusta tarkoituksesta ja annettava kaikki asiaankuuluvat lis\u00e4tiedot tietosuoja-asetuksen mukaisesti.<\/p><p>T\u00e4m\u00e4n lis\u00e4ksi on huomioitava, ett\u00e4 lakis\u00e4\u00e4teisten potilastietojen k\u00e4ytt\u00f6tarkoituksen on muutoksen j\u00e4lkeenkin oltava potilassalaisuutta koskevan lains\u00e4\u00e4d\u00e4nn\u00f6n sallimat.<\/p><p>P\u00e4ivitetty 13.9.2025<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ce39065 elementor-widget elementor-widget-text-editor\" data-id=\"ce39065\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p><strong><span style=\"font-family: Montserrat;
